provides web page hosting and email services. Croaking Toad has certain
legal and ethical responsibilities regarding the use of its computer
network and equipment involved in these services.

Croaking Toad Hosting's
general policy is to act as a neutral provider of access to the global
Internet and has specific ethical concerns regarding the use of its
computers detailed below. Croaking Toad reserves the right to suspend or
cancel any customer's access to any or all services provided by Croaking
Toad when Croaking Toad determines that the account in question has been
used in an inappropriate manner or in such a way as to be inconsistent
with the purpose of our acceptable use policy. Any account cancelled due
to violations of the acceptable use policy will not receive a refund of
any monies paid. Any remaining balance shall be used to pay for the
cancellation of the account. Croaking Toad Hosting reserves the right to
modify, change or replace any or all sections of this policy without
notice to the customer. It is the responsibility of the customer to
periodically review this policy to ensure continued compliance.
Continued use of our service implies a continued acceptance of this
policy.
Unauthorized Use of Services
Croaking Toad Hosting will strongly react to any use or attempted use of
an Internet account or computer without the owner's authorization. Such
attempts include "social engineering" (tricking other people into
releasing their passwords), password cracking, security hole scanning or
other methods of intrusion or entry.
Any unauthorized use of
accounts or computers by a Croaking Toad customer, whether or not the
affected account or computer belongs to Croaking Toad will result in
action against the attacker. Possible actions include warnings, account
suspension or cancellation, and/or civil or criminal legal action.
Unsolicited Commercial Advertisements
Unsolicited commercial advertisements are not permitted via email.
Commercial advertisements are unwelcome in most Usenet discussion groups
and on most email mailing lists. Inappropriate posting or emailing may
result in account suspension or cancellation. See the newsgroup or
mailing list's charter to determine whether advertising is allowed or
not. "Spamming" or sending a message to many different off-topic
newsgroups is particularly unethical and may result in account
suspension or cancellation.
Sending a message,
especially an advertisement, to more than five or six recipients is
considered spamming unless the recipients have specifically requested to
be added to a mailing list on that topic. Email is a person-to-person
medium and not a broadcast medium.
Adult Sites
Croaking Toad will not host adult/pornographic sites. Any sites
that are found to contain this content will be warned, suspended or
cancelled at the sole discretion of Croaking Toad Management.
Croaking Toad customers are privileged to be offered high bandwidth and
storage space for their websites. The intention of Croaking Toad Hosting
is to provide a large space to serve web documents and not an
offsite storage area for electronic files. All webpages must be
hyperlinked with all files stored on our server. Customer agrees to pay
for additional generated transfer over his/her account limit. Customer
will be charged according to our current price list posted on the
Hosting page of this site.
Lawful Purpose
Croaking Toad reserves the right to refuse service to anyone without
explanation. Customers may only use Croaking Toad's server for lawful
purposes. Transmission or storage of any material in violation of
Federal, State or Local regulation is strictly prohibited. This includes
but is not limited to copyrighted material, material judged to be
threatening or obscene and material protected by trade secrets.
Indemnification
Customer agress that it shall defend, indemnify, save and hold Croaking
Toad harmless from any and all demands, liabilities, losses, costs and
claims, including reasonable attorney's fees asserted against Croaking
Toad, its agents, customers, officers and employees that may arise or
result from any service provided or performed or agreed to be performed
or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless Croaking Toad
Hosting against liabilities arising our of; (1) any injury to person or
property caused by any products sold or otherwise distributed in
connection with Croaking Toad's server; (2) any material supplied by
customer infringing or allegedly infringing on the proprietary rights of
a third party; (3) copyright infringement; (4) and any defective
products sold to customer from Croaking Toad's server.
